PT Permata Putera Mandiri (Blok I)

Concession Information: PT Permata Putera Mandiri Blok I is located in the province of West Papua. The concession covers an area of 34,310 hectares1. (Long 132°21’17.93″E, Lat 1°53’45.09″S)

 

 

Deforestation:

In 2015, the ANJ Group was suspended by a number of its palm oil customers over its clearing of forests in the PT Permata Putera Mandiri concession. The company stopped clearing forests for over two years, though started clearance again in late 2017. Satellite imagery (see below) shows that between May 25 to July 9, 2018, a total of 82 hectares of forest were cleared in the PT Permata Putera Mandiri Blok I concession.

PT Permata Putera Mandiri is owned by PT Austindo Nusantara Jaya Agri, a subsidiary of PT Austindo Nusantara Jaya Tbk (ANJ Group)2. Mr. Geetha Govindan is the President Director of Austindo Nusantara Jaya Tbk.

Family ownership – Korompis family

PT Berau Karetindo Lestari is ultimately owned by the Korompis family and by Peak Capital Pte Ltd, a Singapore-based holding company owned by Flamire Holdings Limited (registered in the British Virgin Islands). PT Berau Karetindo Lestari Commissioner Daniel Wewengkang Korompis and Director Didi Ferdinand Korompis are listed in the ‘Panama Papers’ for their registered assets in the British Virgin Islands; their company, Solidi Silvester Korompis, is also registered there.

Group Ownership – Tsani Hutani Abadi Group

PT Rayatama Jaya is part of the Tsani Hutani Abadi Group, ultimately owned by Centrino Investment Ltd, registered in Labuan Island (Malaysia). The Tsani Hutani Abadi Group also owns another plantation company in Kutai Barat, PT Harapan Rimba Haya, PT Kruing Lestari Jaya. Tsani Hutani Abadi’s President Director is Mulyawan Tjandra, who is an ex-Executive Director of Indo Agri Resources. Mr. Gunawan Kosasih is a Director of the group.

PT Pipit Citra Perdana

 

 

Concession Information: PT Pipit Citra Persada is located in Nunukan Regency, East Kalimantan. The concession covers 16,300 hectares. (Long 117° 7’43.56″E, Lat 3°39’18.74″N)

PT Pipit Citra Perdana is owned by PT Xiang De and is associated with the Hang Ting Group (Singapore). Juliet Kristianto Liu is the director of both PT Pipit Citra Perdana and Hang Ting Group.7 Hang Ting has a joint-venture palm oil company with QL Resources Sdn Bhd called PT Pipit Mutiara Indah,8 located in the same district as PT Pipit Citra Perdana.

Concession Information: PT Subur Karunia Raya is located in Teluk Bintuni Regency, in the province of West Papua. The concession covers 40,882 hectares. (Long 133° 0’24.61″E, Lat 1°53’10.84″S)

PT Subur Karunia Raya is 99.6% owned by PT Mulia Abadi Lestari10, controlled by Tuan Junus Sutiono and Tuan Watson Dharma. PT Mulia Abadi Lestari owns 29.1% shares in PT Duta Rendra Mulya, a plantation company majority owned by Anthoni Salim (the CEO and President of the Salim Group).

PT Kapuasindo Palm Industry

PT Sumur Pandawangi is a part of the Musirawas Group, which is still commonly referred to as the Asam Jawa Group.

The Musirawas Group owns three plantation companies which operate in the Seruyan and East Kotawaringin districts of Central Kalimantan. Together they hold a total land bank of 34,000 hectares, with roughly 24,000 hectares producing oil palm. Musirawas has four operational palm oil mills.

The founder of the oil palm operations is Mr. Widjojo Soejono, was a General in the Indonesian National Armed Forces (TNI). Each of his five children have a 20% share in the company.

PT Mulia Inti Perkasa

 

 

Concession Information: PT Mulia Inti Perkasa is located in Berau Regency, East Kalimantan. The concession covers 5,686 hectares. (Long: 116°55’5.70″E, Lat: 2°18’2.01″N)

PT Mulia Inti Perkasa is part of the Widya Corporation.17 Through its fully owned subsidiary, PT Unggul Widya Teknologi Lestari18, it has a total planted area of ~30,000 hectares and owns 5 palm oil mills in West Sulawesi and East Kalimantan.

Mr. Tjokro Putro Wibowo is the Chief Director of the Widya Corporation and PT Unggul Widya Teknologi Lestari. He also serves as general secretary deputy of the Board of the (Indonesian Palm Oil Association (GAPKI)19 and he is a member of the Indonesian Palm Oil Board (DMSI).

PT Prasetya Mitra Muda Blok II

PT Prasetya Mitra Muda is 49.7% owned by Samuel International Group, with the remaining shares owned by Samuel International’s Executive Director and other related members of associated companies22. The Executive Director of Samuel International’s oil palm operations is Mr. Teguh Patriawan. He is also Deputy Chairman of the Plantation Committee of the Indonesian Chamber of Commerce and Industry (Kadin). Samuel International Group subsidiaries include PT Samuel Sekuritas Indonesia and PT Samuel Asset Manajemen, which is among the 10 largest asset managers in Indonesia.

BLD Plantation Bhd is part of the KTS group of companies. The group is controlled by the Lau family and their relatives, as well as the Wan Hamid family. Dato Henry Lau Lee Kong is the Executive Chairman of BLD Plantation, while Mr. Haji Wan Abdillah bin Wan Hamid is the group’s Executive Director. Lau is also the Honorary Secretary of the Sarawak Timber Association (STA).

Mr. Tjia Ke Seng (alias ‘Dachlan’), a Chinese citizen, is the President Director of PT Palem Segar Lestari. He is also the Director of PT Sebaung Sawit Plantation, also located in North Kalimantan.

PT Megakarya Jaya Raya



 

Concession Information: PT Megakarya Jaya Raya is located in Papua province. The concession covers 39,424 hectares. (Long 140°17’03.5″E, Lat 6°24’54.3″S)

 

Deforestation: Since January 2014, over 4,000 hectares of forest were cleared in PT Megakarya Jaya Raya. Satellite imagery (see below) shows that for the period March 31 to May 30, 2018,a total of 31 hectares of forest were cleared in the PT Megakarya Jaya Raya concession.

Ownership Information: 

In 2012, four UAE holding companies (Prestige Holding Ltd., Malindo Investments Ltd, Crescent Investments Ltd, and Green Resources Ltd) believed to be affiliated with the Yemen-based HSA Group each purchased an 80% stake in each of these four companies in the Boven Digoel district of West Papua, Indonesia: PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two of the concessions included in the Tanah Merah project in Boven Digoel Regency. These concessions in the Tanah Merah area cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest has been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as their President Commissioner on their Notary Acts; Fouad Hayel Saeed is HSA Group’s subsidiary Pacific Inter Link’s Managing Director & the Regional Director-Malaysia for HSA Group. The Acts also listed Salah Ahmed Hayel Saeed as the Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and the President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama; Hayel Saeed is the Director of Pacific Inter Link’s refining division PT Pacific Palmindo Industri. Recent Notary Acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and the President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappears from PT Kartika Cipta Pratama’s Notary Acts.

However, the June 5, 2018 Notary Acts show that there is no change is the shareholders of PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. Hence, it is assumed that these companies remain affiliated with the HSA Group.

Little is known about the new directors of the two concessions, except they include some notable individuals in Indonesian politics and business. Mr. Alwi Abdurrahman Shihab has become the president commissioner of PT MJR. He is a former Foreign Minister of Indonesia. Drs. Tommy Sagiman is now the commissioner of PT KCP. He is an ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT MJR in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is the Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.

The HSA Group is one of the oldest business conglomerates in the Middle East, founded in 1938 by Al Haj Hayel Saeed Anam and his brothers Mohamed, Abdo and Gazern. The Group is today headed by Abdul Gabbar Hayel Saeed, its Chairman and CEO.

The HSA Group is involved in the palm oil industry through its subsidiaries PT Pacific Palmindo Industri, PT Pacific Medan Industry, PT Pacific Indomas, PT Pacific Indopalm Industries, Pacific Oil & Fats Industries and Pacific Inter-Link, which are all members of the RSPO.

 

Supply Chain Information: 

Pacific Inter-Link used to trade with IOI and Nestlé, however both companies have suspended trade with the company due to concerns over its involvement in deforestation. It is unclear where Pacific Inter-Link now sells its palm oil, but being a Middle Eastern company, it most likely has an alternative market in this region and in East Africa.

PT Kartika Cipta Pratama


 

 

Concession Information: PT Kartika Cipta Pratama is located in Papua province. The concession covers 41,257 hectares. (Long140°16’20.3″E,Lat 6°21’50.1″S)

 

 

Deforestation: Satellite imagery (see below) shows that for the period March 31 to May 31, 2018, a total of 322 hectares of forest were cleared in the PT Kartika Cipta Pratama concession.

Ownership Information: 

PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are believed to be affiliated with the Yemen-based HSA Group through its subsidiary Pacific Inter-link. (See ownership information section under PT Megakarya Jaya Raya for full details).

 

Supply Chain Information: 

Pacific Inter-Link used to trade with IOI and Nestlé, however both companies have suspended trade with the company due to concerns over its involvement in deforestation. It is unclear where Pacific Inter-Link now sells its palm oil, but being a Middle Eastern company, it most likely has an alternative market in this region and in East Africa.

PT Krida Dharma Kahuripan

Unilever, Nestlé, PepsiCo and Procter & Gamble are also purchasing from Makin via some of the customers mentioned in the table.

PT Kapuasindo Palm Industry



 

Concession Information: PT Kapuasindo Palm Industry is located in Kapuas Hulu Regency, West Kalimantan. The concession covers 19,233 hectares. (Long 111°51’58.78″E, Lat 0°42’15.90″N)

 

 

Deforestation: Satellite imagery (see below) shows that for the period April 22 to June 22, 2018, a total of 59 hectares of forest were cleared in the concession PT Kapuasindo Palm Industry, including 26 hectares of peatland forest.

Deforestation: PT Rayatama Jaya was featured in the Rapid Response Report 2, which showed that for the period March to November 2017 a total of 240 hectares of forest were cleared in the concession. Satellite imagery (see below) shows that for the period April 29 to June 22, 2018, a total of 48 hectares of forest were cleared in the PT Rayatama Jaya concession.

Concession Information: PT Persada Kencana Prima is located in North Kalimantan. The concession covers 15,531 hectares. (Long 117°06’07.2″E, Lat 3°42’46.6″N)

 

 

Deforestation: Between January 2015 and July 2017, PT Persada Kencana Prima cleared and developed a total of 3,708 ha of peatland forest and non-forested peatland. Deforestation:Satellite imagery (see below) shows that for the period May 22 to June 23, 2018, a total of 221 hectares of peatland forest were cleared and an additional 171 hectares of non-forested peatland was developed in the BLD Plantation Bhd concession (392 ha in total). This concession was featured in the Rapid Response Report 4: between March to May 2018 a total of 904 hectares of forest were cleared. For the period September 2017 to June 2018, more than 1,500 hectares of peatland forest and non-forested peatland were cleared or developed in the BLD Plantation Bhd concession.

Deforestation: PT Permata Putera Mandiri Blok I (PT PPM) was featured in Rapid Response Report 3 due to clearance, and that clearance has continued since the release of the report. We found 668 hectares of clearance between June 2017 and December 2017. Satellite imagery (see below) shows that 951 hectares of forest were cleared in the concession from March 11 to May 25, 2018.

However, it looks like the deforestation is currently due to forestry activities. It is likely that once the valuable timber has been extracted the company will plant oil palm.

Mr. Chiong Ho Ling is the chairman and founder of Shin Yang Group of companies. He also serves as executive chairman of Sarawak Oil Palms Bhd. Sarawak Oil Palm Bhd had recently purchased Shin Yang Oil Palms Sdn Bhd.

 

Supply Chain Information: 

Shing Yang group sells timber and FFB to Sarawak Oil Palms Bhd. Among the main known buyers of Sarawak Oil Palms are Sime Darby, Reckitt Benckiser, Nestlé, Mars, ADM, General Mills and Cargill.

Concession Information: PT Agriprima Cipta Persada (PT ACP) is located in Papua province. It covers an area of 59,796 hectares. (Long 140°32’15.31″E, Lat 7°26’12.59″S)

 

 

Deforestation: PT ACP was featured in Rapid Response Report 3. There were 2,847 hectares cleared in 2015 and 2016, evidence of new stacking lines from November to December 2017, and clearing of 70 hectares from November 2017 to January 2018. Satellite imagery (see below) shows that 115 hectares of forest were degraded in the concession from March 9 to early June 2018.

The 5% remaining are owned by PT Karya Agung Megah Utama (KAMU), controlled by Ganda and Jacqueline Sitorus whom hold 68% and 32% of the shares respectively, while Andy Indigo is Director.

Ownership Information: 

PT Sawit Mandiri Lestri was sold by Sawit Sumbermas Sarana (SSMS) in December 2015 while there was a RSPO complaint pending inititated by the NGOs Environmental Investigation Agency and JPIK Kalteng. The company is, therefore, no longer subject to the RSPO’s Principles and Criteria. PT SML is 60% owned by Rinawati and 40% owned by Hamidi Mukhdar Said, through PT Metro Jaya Lestari.

No information could be found concerning Rinawati but Hamidi Mukhdar Said is a member of Commission IV of the house of representatives of Indonesia. The director mentioned in PT SML’s notary act is also the commercial director of SSMS (Ramzi Sastra) and the address of PT SML is the same as the address of another plantation company belonging to SSMS. This concession still appears to be connected to the Abdul Rasyid family.

Supply Chain: Based on mill vicinity (see map), PT BAPP likely supplies FFB to PT Yong Jing Investama, which does not feature on any public supplier lists.

Ownership Information: There are many linkages between PT BAPP and Salim Group:

• The plantation company is ultimately owned by Mr. Ir Daud through PT Cahaya Agro Pratama. Mr. Ir Daud is a former director of PT Duta Rendra Mulya, which is linked to Salim Group.

• Mr. Gunawan Sumantri, the president director of PT BAPP is also a former director of Salim companies: PT Duta Rendra Mulya and PT Andhika Wahana Putra. Concession information: PT Kahayan Agro Plantation is located in Gunung Mas Regency, Central Kalimantan, and covers an area of 17,500 hectares.

 

 

 

 

Deforestation: Between October 16, 2016 and September 26, 2017, an estimated 420 hectares were deforested (see satellite imagery below), including clearing of Bornean orangutan habitat as per the most recent orangutan distribution maps [Utami-Atmoko and al.: Orangutan Population and Habitat Viability Assessment: Final Report. IUCN, 2017]

Prior to October 2016, an estimated 3,593 hectares were cleared, including over 700 ha of orangutan habitat.

Supply chain: PT KAP likely supplies FFB to PT Tantahan Panduhup Asia, owned by Sumber Tani Agung, which is a known supplier to Wilmar.

Ownership information: PT Kahayan Agro Plantation is owned by Anglo Eastern Plantations.

 

 

Land conflicts and licensing issues at PT KAP:

Within two weeks of the acquisition of PT KAP by Anglo Eastern Plantations in 2010, the Regent of Gunung Mas issued a Plantation Business Permit (IUP) for the entire area, despite no Environmental Impact Analysis (AMDAL) having been carried out. During the subsequent AMDAL process, local Dayak communities stressed that they did not want the company on their lands.

The concerns of local people resulted in the Regent issuing a decree to PT KAP to excise local land from their concession, and banned them from negotiating land sales with local people without the regency government’s permission.

In January 2013, the Governor of Central Kalimantan issued a directive that PT KAP must comply with the Regent’s instruction, and conduct an inventory of all land claims within the concession.

Despite this, PT KAP continued its own process of acquiring land, and the directives from both the Regent and Governor appeared to have been ignored. Customary lands were not excised from the IUP area.

In 2012, a Permit for wood utilization (IPK) was issued to a third-party, PT Kahayan Hutan Lestari (KHL). Clearing and planting began on the plantation [bit.ly/2glvOhq].

In 2014, NGO reports accused PT KHL of clearing more timber on the concession than was stipulated in its license, and PT KAP of operating without a HGU license [bit.ly/2uSSq17].

 

 

 

 

 

PT Mustika Agung Sentosa



 

 

Concession information: PT Mustika Agro Sentosa (PT MAS), is a plantation company located in West Kalimantan with an area of 19,792 hectares, based on IUP permit.

 

Deforestation: Between January 2017 and August 2017, PT MAS cleared around 10 hectares of forest on the South and Northeast of its concession.

 

 

Supply chain: Based on mill vicinity (see map), PT MAS likely supplies FFB to PT Parindu or Simpang Hulu Barat, which main known buyers are Wilmar, IOI, Cargill and ADM. 

Ownership information:

• PT MAS is ultimately owned by Pribadi and Wiyono families (50/50%) through PT Citra Bumi Semesta and PT International Timber Inticor, respectively.

• Mr. Henry Pribadi, whose real name is Liem Oen Hauw, owns 77.5% shares in PT Citra Bumi Semesta, while his children own the remaining 22.5%. Mr. Henry Pribadi is one of the richest Indonesians who owns, among others, Napam cement group and the famous SCTV television network [bit.ly/2i8SA04].

• He is the cousin of Mr. Djuhar Sutanto, a very close business partner of Mr. Sudono Salim (father of Anthony Salim) and is also sitting as secretary and commissioner of some Salim’s companies [bit.ly/2g6GGQ0, bit.ly/2i8Bz6r].

• PT International Timber Inticor is owned 50/50% by Ellen and Jeffry Wiyono.
