Astra Clearing Forest NOW in Rare Orangutan Habitat

New Satellite Imagery Shows October 2021 Forest Destruction

BATANG TORU, NORTH SUMATRA, 9 NOVEMBER 2021 – New satellite imagery caught Indonesian mining, financial services, auto and agribusiness giant Astra International destroying the home forests of the rarest great ape in the world – as recently as last week. The investigation shows operations at Astra’s Martabe gold mine eating away at the habitat of the critically endangered Tapanuli Orangutan between October 9 and 29, 2021.[1]

“Since February, Astra has been in talks over a plan to gauge the impact of the neighboring Martabe mine on Tapanuli Orangutan habitat,” said Annisa Rahmawati, Environmental Advocate at Mighty Earth. “But while talks have dragged on for months, this new evidence shows deforestation continuing all along.”

The Tapanuli orangutan (Pongo tapanuliensis) was identified in just 2017, the first time since the 1920s that a new species of great ape had been found. Indonesia is the only country outside of the Democratic Republic of the Congo that can boast of being home to three species of Great Ape. Fewer than 800 Tapanuli orangutans exist in the world, less than any other great ape species.

“The Batang Toru ecosystem landscape is our last frontier forest in North Sumatra. The government should evaluate all permits on this landscape and take a firm action against companies that threaten the sustainability of this critical landscape,” said Roy Lumbangaol, a campaign manager at WALHI North Sumatra.

Astra International is also a major player in the palm oil sector, with a special policy on deforestation. Its managed palm plantation operations and trading operations (under the company name Astra Agro Lestari) operate under a No Deforestation policy.

“Astra has not extended its palm oil sustainability policy to operations like the Martabe mine,” said Annisa . “That’s even though many of their consumer-product customers like Hershey’s and Unilever have cross-commodity-deforestation commitments on record. In essence, this recklessness around Martabe puts their entire agribusiness operation at risk.”

Scientists estimate that the Tapanuli orangutan population has almost halved since 1985, and it will continue to decline unless comprehensive protection measures are implemented. Conservation biologists have projected that if the adult population decreases by more than 1% of

 each year, the genetic diversity of the primate will decline to the point that it will go extinct That’s why scientists with the International Union for the Conservation of Nature have called for a moratorium [2] on the development of projects impacting the Tapanuli orangutan’s habitat.

The Batang Toru Ecosystem is also home to the critically endangered Sumatran tiger, pangolin and helmeted hornbill. Sun bears, tapir, serow and a host of other rare endangered species, including more than 300 bird species, also rely on this habitat.

Agribusiness giants JBS and Cargill complicit in razing forests, new monitoring system reveals  

 

Today, Mighty Earth launches its Soy & Cattle Deforestation Tracker, a unique monitoring system that links megafarms responsible for large-scale deforestation and land clearance in the Brazilian Amazon and Cerrado to major soy traders and meatpackers. The Tracker provides unprecedented visibility into opaque and destructive supply chains. 

The Tracker combines near real-time satellite deforestation data with investigative supply chain research provided by research group Aidenvironment. The top 10 major soy traders and meatpackers in Brazil are then ranked based on the extent, severity, and response to the deforestation and ecosystem conversion in their supply chains 

Two major agribusinesses JBS and Cargill are the worst performing companies with respective scores of 1 and 25 out of 100 possible points. JBS, a Brazilian-owned beef company, is linked to 42,538 hectares of conversion – an area about half the size of New York City. Nearly 50% of this clearance represents possible illegal clearance under Brazilian law. JBS is the top importer of beef from Brazil into the United States.  

Cargill, the largest privately held company in the US and major soy trader, is connected to megafarms that have cleared 61,260 hectares in Brazil’s Amazon and Cerrado – an area about the size of Chicago. Brazilian soy from Cargill and other soy traders typically ends up as animal feed for livestock. 

Many of the world’s leading brands have made commitments to achieve zero-deforestation in their supply chains by 2020, yet they continue to buy from corporations like JBS and Cargill connected to deforestation and land clearance. 

Mighty Earth’s research shows that retailers like Walmart, Costco, Kroger, Ahold Delhaize USA, and Publix sell JBS products, while Costco, Stop & Shop and Food Lion all buy from Cargill 

American customers have spoken out loudly and clearly – they don’t want to be complicit in the destruction of Brazil’s precious forests,” Asha Sharma, Director at Mighty Earth said. However, retailers and their suppliers – the soy traders and meatpackers featured in our Tracker – continue to allow business as usual. These corporations must take immediate action to address customers’ demands and purge deforestation from their supply chains.” 

No corporation featured in the Tracker scores higher than a 66, indicating the large extent to which the Brazilian soy and cattle sectors are linked to deforestation. The two other US companies included in the Tracker – Archer Daniels Midland Company (ADM) and Bunge also perform poorly with respective scores of 47 and 31. 

According to Brazil’s space agency (INPE) deforestation in the Brazilian Amazon has surged to a 12-year high. Uncontrolled expansion of industrial agriculture, particularly for beef and soy production, is the leading cause of Brazil’s deforestation. 

Customers have the right to know how their food is produced and whether their purchases are associated with environmental destruction. Mighty Earth’s Soy & Cattle Deforestation Tracker shows the importance of publicly available monitoring systems that hold corporations accountable to their sustainability commitments and promises to their customers, Sharma said. 


Consumer Brands Set Precedent by Suspending Samling Group

As the notorious timber and palm oil conglomerate Samling Group continues to destroy rainforests, Mighty Earth’s new scorecard reveals that many consumer brands like Nestlé and Unilever have taken action to suspend the group from their palm oil supply chains 

These actions could signal a new trend of adopting zero tolerance towards egregious groups that continue to engage in deforestation, peatland destruction and exploitation of vulnerable forest-dependent communities. However, urgent action is needed to close out markets for other rainforest destroyers like Samling. 

Our Rapid Response Deforestation Monitoring system uses satellite imagery to detect new instances of deforestation and peatland development across palm oil and timber plantations in Indonesia and Malaysia. The system identified at least 1,038 hectares of deforestation since August 2017 within Samling’s concessions in Sarawak, Malaysia. This is one of the largest amounts of deforestation by any single group detected by Rapid Response over the past three yearsFurthermore, the company has a long history of egregious human rights abuses.  

Therefore, buying palm oil from Samling constitutes a serious violation of the No-Deforestation, No-Peat and No-Exploitation (NDPE) policies that many of the world’s largest consumer brands have adopted. Mighty Earth reviewed the publicly available palm oil mill lists of these brands and contacted 17 companies that disclosed supply chain links to Samling. 

More than half of the 17 brands have taken the progressive step of instructing their suppliers to suspend Samling, earning an “A” score. These companies include Colgate-Palmolive, Danone, FrieslandCampina, Hershey’s, Nestlé, PZ Cussons, Reckitt Benckiser, Unilever and Upfield. 

By issuing a clear suspension instruction to their direct suppliers, these brands have taken a preventative stance on purging Samling palm oil from their supply chains. These suspensions block potential points of leakage from other companies that continue to source from Samling, such as BLD Plantation (part of the KTS Group), even though the company has adopted an NDPE policy. They also ensure that brands are not reliant on their direct suppliers – palm oil traders – to maintain suspensions themselves on rogue palm oil producers and sends a much stronger signal upstream that noncompliant producers will not have access to the NDPE markets. 

An example of an “A score from a brand is: We have communicated the suspension of direct / indirect supply from this group until further investigations and corrective actions are taken.” 

Many other brands have failed to issue a clear directive to all suppliers to suspend Samling but have engaged with their palm oil suppliers to ensure Samling palm oil is not entering their supply chains, receiving a “B.” These companies are General Mills, Johnson & Johnson, Kellogg’s, Mars, P&G and PepsiCo 

An example of a “B” score from a brand is: We identified potential links through several of our direct suppliers. We reached out to all suppliers with potential links to Samling and confirmed that all have either suspended or will not engage Samling in their supply chains.” 

Avon and Mondelēz International have failed to respond to Mighty Earth’s repeated emails, earning an “F.”  

In total, 88% of brands in our scorecard have taken varying levels of action to expel Samling palm oil from their supply chains. Notably, these consumer brands acted largely as a result of the evidence of Samling’s ongoing deforestation for timber plantations rather than for palm oil production Doing so demonstrates that brands have begun to understand the need to implement a group-level, cross-commodity approach to eradicating deforestation from their supply chain. For true transformational change, brands should exclude groups from their supply chains that continue to engage in deforestation and human rights abuses, regardless of what commodity was the driver of the violations.  In the end, the profits from commercial purchases go to the group’s owners or beneficiaries, who use them to continue their destructive practices and/or expand their business.  

However, more action is needed. Samling continues to destroy rainforest and has not adopted a group-wide NDPE policy or committed to remediate past destruction and abuses. Other tycoon-owned Sarawak logging and palm oil conglomerates such as Rimbunan Hijau Group and Shin Yang Group continue to clear rainforest in Sarawak and are still in the supply chains of major palm oil traders and consumer brands.   

The Samling case illustrates the value of transparency.  Based on companies’ public mill lists, Mighty Earth was able to communicate with key buyers of Samling and enable them to take action.  Those brands whose supply chains remain hidden from public view remain at severe risk of having rogue actors like Samling lurking in their supply chains. They cannot guarantee consumers that they have proper due diligence processes in place to eliminate deforestation and human rights violations from their supply chains.  For example, brands such as McDonald’s, Burger King, Starbucks and Yum Brands! have refused to release any publicly available information about the mills that they’re sourcing their palm oil from.   

Until consumer brands commit to true traceability, transparency and implementation of their NDPE policies, palm oil from unethical suppliers like Samling will continue to infiltrate the supply chains of many of the brands we know and love.

Cargill Hides its Deforestation Impacts in Misleading Report

As yet another company distances itself from Cargill, the agribusiness giant has attempted to satiate its customers’ demands for reform with a new, deceptive report. Cargill’s 2020 Soy Progress Report Mid-Year Update touts the company’s progress mapping its Brazilian supply chain for soybeans and calculating the share of its soy grown on deforestation- and conversion-free land. However, an analysis by Mighty Earth mapping and supply chain experts has found that Cargill’s accounting methods are both grossly inaccurate and intentionally misleading.

Key problems we identified with the report are:

  • Overstating the percentage of Cargill soy that is deforestation and conversion free (DCF). Cargill claims that 95.68 percent of its soy volumes qualify, but uses data too vague and generic to actually attribute DCF sourcing to its farms. Independent reports from organizations like Trase have found Cargill to have the second highest deforestation risk in Brazil out of all soy exporters. Cargill cannot claim that any of their soy is deforestation-free until more improvements are made in their supply chain traceability, transparency and monitoring efforts.
  • Ignoring Critical Role of Cargill’s Indirect Suppliers. Cargill claims that is has mapped 100 percent of its suppliers. In truth, this statement covers only the company’s direct suppliers, which account for just 69 percent of the total supply chain. The information Cargill did collect about indirect suppliers only includes the “points of procurement,” i.e., where they bought the soy from. These locations can be silos or other aggregation points and are, in terms of monitoring for deforestation, entirely useless information.
  • Exaggerating the Accuracy of Cargill’s Mapping. Cargill admits in the report that it has only single-mapped the suppliers. Single-point mapping shows generally where a farm is located, but it is not useful information for a comprehensive monitoring effort. A single point on a map can hardly encapsulate the full scale of some of these soy plantations, which can stretch for thousands of kilometers. This style of mapping is therefore insufficient for making claims of being deforestation and conversion free. In order for a monitoring system to accurately track deforestation, it must document the full boundaries of properties for both direct and indirect suppliers in its supply chain.
  • Sweeping Other Important Issues Under the Rug. Cargill did not report on any other impacts of its deforestation, including illegal clearance, clearance on Indigenous and community lands, or use of fires – but the company is known to have impacts in all of these areas. Ignoring these issues does nothing to mitigate their destruction.

Cargill has long prioritized press releases and public relations strategies over tackling the thorny issues that have earned them the reputation as the “Worst Company in the World.” And while they dither, forests continue to burn. Supermarkets like Costco, Ahold Delhaize, and Casino must demand true accountability and action from Cargill or find another business partner, because people around the around the world expect better from the brands they trust.

Concession Information: PT Kartika Cipta Pratama is located in Boven Digoel Regency, Papua. The concession covers a total area of 41,257 hectares. (Long 140°12’31.6″E, Lat 6°20’26.6″S)

 

 

 

 

Deforestation:

Satellite imagery (see below) shows that between January 11, 2019 and January 31, 2019, a total of 77 hectares of forest were cleared in the PT Kartika Cipta Pratama concession. (Imagery Sentinel-2).

Ownership Information: 

In 2012, four UAE holding companies (Prestige Holding Ltd., Malindo Investments Ltd, Crescent Investments Ltd, and Green Resources Ltd) believed to be affiliated with the Yemen-based HSA Group purchased 80% stake of each of these four companies located in the Boven Digoel district of West Papua, Indonesia: PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two concessions involved in Tanah Merah project in Boven Digoel Regency. These concessions cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest have been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as President Commissioner on their notary acts. Fouad Hayel Saeed is Regional Director-Malaysia of the HSA Group and Managing Director of Pacific Inter-Link, the group’s subsidiary. Legal documents also listed Salah Ahmed Hayel Saeed as Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama. Hayel Saeed is Director of Pacific Inter-Link’s refining division, PT Pacific Palmindo Industri. Recent notary acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappeared from PT Kartika Cipta Pratama’s notary acts.

However, June 5, 2018 notary acts does not show any change in PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana shareholders. Hence, it is assumed that these companies remain affiliated with the HSA Group. Little is known about the new directors of the two concessions, except that some notable individuals in Indonesian politics and business are involved. Mr. Alwi Abdurrahman Shihab, former Foreign Minister of the Indonesian government, has become President Commissioner of PT Megakarya Jaya Ray. Drs. Tommy Sagiman is now the commissioner of PT KCP. He is ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT Megakarya Jaya Raya in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is the Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.

The HSA Group is one of the oldest business conglomerate in the Middle East, founded in 1938 by Al Haj Hayel Saeed Anam and his brothers Mohamed, Abdo and Gazern. The Group is today headed by Abdul Gabbar Hayel Saeed, CEO and Chairman. The HSA Group is involved in the palm oil industry through its subsidiaries PT Pacific Palmindo Industri, PT Pacific Medan Industry, PT Pacific Indopalm Industries, Pacific Oil & Fats Industries and Pacific Inter-Link, which are all RSPO members2, and PT Pacific Indomas.

Additional evidence shows continued family links to the PT Tulen Jayamas Timber Industries timber complex, a joint-venture project with Bumimas Raya Sdn Bhd, Pacific Inter-Link Sdn Bhd, Yakin Dijaya Sdn Bhd and Al Salam Bank Bahrain’ announced by Tadmax Resources in 2012.3 The PT Tulen Jayamas Timber Industries timber complex is situated within the PT Kartika Cipta Pratama concession.

Malindo Investments Ltd which holds 80% shares in PT Kartika Cipta Pratama (see above), also holds 40% of the shares in the Malaysian-based parent company of PT Tulen Jayamas Timber Industries – i.e. Tulen Jayamas Sdn Bhd. Mr. Salah Ahmed Hayel Saeed and Mr. Fouad Hayel Saeed Anam are directors of Tulen Jayamas Sdn Bhd, in addition to their positions in the Indonesian subsidiary (PT Tulen Jayamas Timber Industries) as of 28 April 2018.

In the period 21 February 2013 to 24 April 2018, Mr Salah Ahmed Hayel Saeed held 1 share in PT Tulen Jayamas Timber Industries, with the remaining 499 shares held by Tulen Jayamas Sdn Bhd. As of 11 November 2018 Mr Salah Ahmed Hayel Saeed and Mr Fouad Hayel Saeed Anam were no longer directors of Tulen Jayamas Sdn Bhd. However, Malindo Investments Ltd still holds 40% in Tulen Jayamas Sdn Bhd.

Between 24 April 2018 and 13 December 2018, Mr Salah Ahmed Hayel Saeed was no longer a shareholder and director in PT Tulen Jayamas Timber Industries. Also, Mr Fouad Hayel Saeed Anam ceased to be a director in PT Tulen Jayamas Timber Industries.

The HSA Group company Pacific Inter-Link (PIL) used to trade with Unilever, IOI, Cargill and Nestlé, however these companies have suspended trade with the company due to concerns over its involvement in deforestation. Linau Sinar Sdn Bhd is wholly owned subsidiary of Shin Yang Holding Sdn Bhd (Shin Yang Group), which is involved in the oil palm and timber sectors in Sarawak.

The Group was founded by Tan Sri Datuk Ling Chiong Ho, who holds 25% of the shares of Shin Yang Holding Sdn Bh, with the remaining shares held equally by his three brothers: Ling Chiong Seing, Ling Chiong Sing and Ling Chiong Ping.

Forbes ranked Ling Chiong Ho as the 48th richest person in Malaysia in 2017 stating that ‘today his Shin Yang Group builds ships, exports timber and develops property. But he derives most of his wealth from listed Sarawak Oil Palms.’

Ling Chiong Ho and his three brothers collectively holds 28.51% of the shares of the publicly listed company Sarawak Oil Palms Bhd (Sarawak Oil Palms Group) through their deemed interest in Shin Yang Plantation Sdn Bhd (a wholly owned subsidiary of Shin Yang Corporation Sdn Bhd, which in turn is a wholly owned subsidiary of Shin Yang Holding Sdn Bhd). Ling Chiong Ho also holds an additional 7.02% shares of Sarawak Oil Palms Bhd.

Hence, the Sarawak Oil Palms Group is part of the broader Shin Yang Group and needs to be treated as one group for the purposes of supply chain grievances.

In 2012, four UAE holding companies (Prestige Holding Ltd., Malindo Investments Ltd, Crescent Investments Ltd, and Green Resources Ltd) believto be ed affiliated with the Yemen-based HSA Group purchased 80% stake of each of these four companies located in the Boven Digoel district of West Papua, Indonesia: PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two concessions involved in Tanah Merah project in Boven Digoel Regency. These concessions cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest have been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as President Commissioner on their notary acts. Fouad Hayel Saeed is Regional Director-Malaysia of the HSA Group and Managing Director of Pacific Inter-Link, the group’s subsidiairy. Legal documents also listed Salah Ahmed Hayel Saeed as Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama. Hayel Saeed is Director of Pacific Inter-Link’s refining division, PT Pacific Palmindo Industri. Recent notary acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappeared from PT Kartika Cipta Pratama’s notary acts.

However, June 5, 2018 notary acts does not show any change in PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana shareholders. Hence, it is assumed that these companies remain affiliated with the HSA Group. Little is known about the new directors of the two concessions, except that some notable individuals in Indonesian politics and business are involved. Mr. Alwi Abdurrahman Shihab, former Foreign Minister of the Indonesian government, has become President Commissioner of PT Megakarya Jaya Ray. Drs. Tommy Sagiman is now the commissioner of PT KCP. He is ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT Megakarya Jaya Raya in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is the Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.
