Concession Information: PT Kartika Cipta Pratama is located in Boven Digoel Regency, Papua. The concession covers a total area of 41,257 hectares. (Long 140°12’31.6″E, Lat 6°20’26.6″S)

 

 

 

 

Deforestation:

Satellite imagery (see below) shows that between January 11, 2019 and January 31, 2019, a total of 77 hectares of forest were cleared in the PT Kartika Cipta Pratama concession. (Imagery Sentinel-2).

Ownership Information: 

In 2012, four UAE holding companies (Prestige Holding Ltd., Malindo Investments Ltd, Crescent Investments Ltd, and Green Resources Ltd) believed to be affiliated with the Yemen-based HSA Group purchased 80% stake of each of these four companies located in the Boven Digoel district of West Papua, Indonesia: PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two concessions involved in Tanah Merah project in Boven Digoel Regency. These concessions cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest have been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as President Commissioner on their notary acts. Fouad Hayel Saeed is Regional Director-Malaysia of the HSA Group and Managing Director of Pacific Inter-Link, the group’s subsidiary. Legal documents also listed Salah Ahmed Hayel Saeed as Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama. Hayel Saeed is Director of Pacific Inter-Link’s refining division, PT Pacific Palmindo Industri. Recent notary acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappeared from PT Kartika Cipta Pratama’s notary acts.

However, June 5, 2018 notary acts does not show any change in PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana shareholders. Hence, it is assumed that these companies remain affiliated with the HSA Group. Little is known about the new directors of the two concessions, except that some notable individuals in Indonesian politics and business are involved. Mr. Alwi Abdurrahman Shihab, former Foreign Minister of the Indonesian government, has become President Commissioner of PT Megakarya Jaya Ray. Drs. Tommy Sagiman is now the commissioner of PT KCP. He is ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT Megakarya Jaya Raya in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is the Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.

The HSA Group is one of the oldest business conglomerate in the Middle East, founded in 1938 by Al Haj Hayel Saeed Anam and his brothers Mohamed, Abdo and Gazern. The Group is today headed by Abdul Gabbar Hayel Saeed, CEO and Chairman. The HSA Group is involved in the palm oil industry through its subsidiaries PT Pacific Palmindo Industri, PT Pacific Medan Industry, PT Pacific Indopalm Industries, Pacific Oil & Fats Industries and Pacific Inter-Link, which are all RSPO members2, and PT Pacific Indomas.

Additional evidence shows continued family links to the PT Tulen Jayamas Timber Industries timber complex, a joint-venture project with Bumimas Raya Sdn Bhd, Pacific Inter-Link Sdn Bhd, Yakin Dijaya Sdn Bhd and Al Salam Bank Bahrain’ announced by Tadmax Resources in 2012.3 The PT Tulen Jayamas Timber Industries timber complex is situated within the PT Kartika Cipta Pratama concession.

Malindo Investments Ltd which holds 80% shares in PT Kartika Cipta Pratama (see above), also holds 40% of the shares in the Malaysian-based parent company of PT Tulen Jayamas Timber Industries – i.e. Tulen Jayamas Sdn Bhd. Mr. Salah Ahmed Hayel Saeed and Mr. Fouad Hayel Saeed Anam are directors of Tulen Jayamas Sdn Bhd, in addition to their positions in the Indonesian subsidiary (PT Tulen Jayamas Timber Industries) as of 28 April 2018.

In the period 21 February 2013 to 24 April 2018, Mr Salah Ahmed Hayel Saeed held 1 share in PT Tulen Jayamas Timber Industries, with the remaining 499 shares held by Tulen Jayamas Sdn Bhd. As of 11 November 2018 Mr Salah Ahmed Hayel Saeed and Mr Fouad Hayel Saeed Anam were no longer directors of Tulen Jayamas Sdn Bhd. However, Malindo Investments Ltd still holds 40% in Tulen Jayamas Sdn Bhd.

Between 24 April 2018 and 13 December 2018, Mr Salah Ahmed Hayel Saeed was no longer a shareholder and director in PT Tulen Jayamas Timber Industries. Also, Mr Fouad Hayel Saeed Anam ceased to be a director in PT Tulen Jayamas Timber Industries.

Supply Chain Information: 

The HSA Group company Pacific Inter-Link (PIL) used to trade with Unilever, IOI, Cargill and Nestlé, however these companies have suspended trade with the company due to concerns over its involvement in deforestation. Pacific Inter-Link claims to be one of the largest palm oil traders to the Middle East, Africa, Russia, Ukraine and Turkey.

Mariya Family: PT Malindo Jaya Diraja

Concession Information: PT Malindo Jaya Diraja is located in Tanah Laut and Balangan Regency, South Kalimantan. The concession covers a total area of 31,043 hectares. (Long 115° 5’25.86″E, Lat 3°47’22.15″S)

The Samling group – which was founded by Tan Sri Yaw Teck Seng, a Malaysian businessman – is engaged in timber, oil palm, property and automotive business ventures.

Group: Shin Yang / Sarawak Oil Palms

Linau Sinar Sdn Bhd is wholly owned subsidiary of Shin Yang Holding Sdn Bhd (Shin Yang Group), which is involved in the oil palm and timber sectors in Sarawak.

The Group was founded by Tan Sri Datuk Ling Chiong Ho, who holds 25% of the shares of Shin Yang Holding Sdn Bh, with the remaining shares held equally by his three brothers: Ling Chiong Seing, Ling Chiong Sing and Ling Chiong Ping.

Forbes ranked Ling Chiong Ho as the 48th richest person in Malaysia in 2017 stating that ‘today his Shin Yang Group builds ships, exports timber and develops property. But he derives most of his wealth from listed Sarawak Oil Palms.’

Ling Chiong Ho and his three brothers collectively holds 28.51% of the shares of the publicly listed company Sarawak Oil Palms Bhd (Sarawak Oil Palms Group) through their deemed interest in Shin Yang Plantation Sdn Bhd (a wholly owned subsidiary of Shin Yang Corporation Sdn Bhd, which in turn is a wholly owned subsidiary of Shin Yang Holding Sdn Bhd). Ling Chiong Ho also holds an additional 7.02% shares of Sarawak Oil Palms Bhd.

Hence, the Sarawak Oil Palms Group is part of the broader Shin Yang Group and needs to be treated as one group for the purposes of supply chain grievances.

According to the Bruno Manser Fund, Radiant Lagoon Sdn Bhd is currently involved in a major conflict with indigenous Penan and Berawan communities as a result of the development of this concession.

In 2012, four UAE holding companies (Prestige Holding Ltd., Malindo Investments Ltd, Crescent Investments Ltd, and Green Resources Ltd) believed to be affiliated with the Yemen-based HSA Group purchased 80% stake of each of these four companies located in the Boven Digoel district of West Papua, Indonesia: PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two concessions involved in Tanah Merah project in Boven Digoel Regency. These concessions cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest have been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as President Commissioner on their notary acts. Fouad Hayel Saeed is Regional Director-Malaysia of the HSA Group and Managing Director of Pacific Inter-Link, the group’s subsidiary. Legal documents also listed Salah Ahmed Hayel Saeed as Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama. Hayel Saeed is Director of Pacific Inter-Link’s refining division, PT Pacific Palmindo Industri. Recent notary acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappeared from PT Kartika Cipta Pratama’s notary acts.

However, June 5, 2018 notary acts does not show any change in PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana shareholders. Hence, it is assumed that these companies remain affiliated with the HSA Group. Little is known about the new directors of the two concessions, except that some notable individuals in Indonesian politics and business are involved. Mr. Alwi Abdurrahman Shihab, former Foreign Minister of the Indonesian government, has become President Commissioner of PT Megakarya Jaya Ray. Drs. Tommy Sagiman is now the commissioner of PT KCP. He is ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT Megakarya Jaya Raya in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is the Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.

The HSA Group is one of the oldest business conglomerate in the Middle East, founded in 1938 by Al Haj Hayel Saeed Anam and his brothers Mohamed, Abdo and Gazern. The Group is today headed by Abdul Gabbar Hayel Saeed, CEO and Chairman. The HSA Group is involved in the palm oil industry through its subsidiaries PT Pacific Palmindo Industri, PT Pacific Medan Industry, PT Pacific Indopalm Industries, Pacific Oil & Fats Industries and Pacific Inter-Link, which are all RSPO members14, and PT Pacific Indomas.

Additional evidence shows continued family links to the PT Tulen Jayamas Timber Industries timber complex, a joint-venture project with Bumimas Raya Sdn Bhd, Pacific Inter-Link Sdn Bhd, Yakin Dijaya Sdn Bhd and Al Salam Bank Bahrain’ announced by Tadmax Resources in 2012.15 The PT Tulen Jayamas Timber Industries timber complex is situated within the PT Kartika Cipta Pratama concession.

Malindo Investments Ltd which holds 80% shares in PT Kartika Cipta Pratama (see above), also holds 40% of the shares in the Malaysian-based parent company of PT Tulen Jayamas Timber Industries – i.e. Tulen Jayamas Sdn Bhd. Mr. Salah Ahmed Hayel Saeed and Mr. Fouad Hayel Saeed Anam are directors of Tulen Jayamas Sdn Bhd, in addition to their positions in the Indonesian subsidiary (PT Tulen Jayamas Timber Industries) as of 28 April 2018.

PT Sumur Pandawangi is part of the Musirawas Group, which owns three plantation companies which operate in the Seruyan and East Kotawaringin districts of Central Kalimantan. Together they hold a total land bank of 34,000 hectares, with roughly 24,000 hectares producing oil palm. Musirawas has four operational palm oil mills.

The founder of oil palm operations is Mr. Widjojo Soejono, who was a General in the Indonesian National Armed Forces (TNI). Each of his five children control 20% of the shares in PT Sumur Pandawangi (through PT Panca Bumisari Utama and PT Mahesi Agri Karya). 22

Musirawas Group also holds shares in other plantations companies affiliated with Asam Jawa. PT Panca Bumisari Utama holds 36% of the shares in PT Sapta Karya Damai, 10% in PT Palma Prima Plantation and 27.5% shares in PT Asam Jawa, which in turn controls 80% of the shares in PT Palma Prima Plantation and 92% of the shares in PT Sawitmas Nugraha Perdana.

In 2012, four UAE holding companies (Prestige Holding Ltd., Malindo Investments Ltd, Crescent Investments Ltd, and Green Resources Ltd) believed to be affiliated with the Yemen-based HSA Group purchased 80% stake of each of these four companies located in the Boven Digoel district of West Papua, Indonesia: PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two concessions involved in Tanah Merah project in Boven Digoel Regency. These concessions cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest have been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as President Commissioner on their notary acts. Fouad Hayel Saeed is Regional Director-Malaysia of the HSA Group and Managing Director of Pacific Inter-Link, the group’s subsidiairy. Legal documents also listed Salah Ahmed Hayel Saeed as Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama. Hayel Saeed is Director of Pacific Inter-Link’s refining division, PT Pacific Palmindo Industri. Recent notary acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappeared from PT Kartika Cipta Pratama’s notary acts.

However, June 5, 2018 notary acts does not show any change in PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana shareholders. Hence, it is assumed that these companies remain affiliated with the HSA Group. Little is known about the new directors of the two concessions, except that some notable individuals in Indonesian politics and business are involved. Mr. Alwi Abdurrahman Shihab, former Foreign Minister of the Indonesian government, has become President Commissioner of PT Megakarya Jaya Ray. Drs. Tommy Sagiman is now the commissioner of PT KCP. He is ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT Megakarya Jaya Raya in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is the Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.

The HSA Group is one of the oldest business conglomerate in the Middle East, founded in 1938 by Al Haj Hayel Saeed Anam and his brothers Mohamed, Abdo and Gazern. The Group is today headed by Abdul Gabbar Hayel Saeed, CEO and Chairman. The HSA Group is involved in the palm oil industry through its subsidiaries PT Pacific Palmindo Industri, PT Pacific Medan Industry, PT Pacific Indopalm Industries, Pacific Oil & Fats Industries and Pacific Inter-Link, which are all RSPO members2.

Additional evidence shows continued family links to the PT Tulen Jayamas Timber Industries timber complex, a joint-venture project with Bumimas Raya Sdn Bhd, Pacific Inter-Link Sdn Bhd, Yakin Dijaya Sdn Bhd and Al Salam Bank Bahrain’ announced by Tadmax Resources in 2012.3 The PT Tulen Jayamas Timber Industries timber complex is situated within the PT Kartika Cipta Pratama concession.

Malindo Investments Ltd which holds 80% shares in PT Kartika Cipta Pratama (see above), also holds 40% of the shares in the Malaysian-based parent company of PT Tulen Jayamas Timber Industries – i.e. Tulen Jayamas Sdn Bhd. Mr. Salah Ahmed Hayel Saeed and Mr. Fouad Hayel Saeed Anam are directors of Tulen Jayamas Sdn Bhd, in addition to their positions in the Indonesian subsidiary (PT Tulen Jayamas Timber Industries) as of 28 April 2018.

Supply Chain Information:

The HSA Group company Pacific Inter-Link (PIL) used to trade with IOI and Nestlé, however both companies have suspended trade with the company due to concerns over its involvement in deforestation. Pacific Inter-Link claims to be one of the largest palm oil traders to the Middle East, Africa, Russia, Ukraine and Turkey.


 

PT Rimbun Sawit Papua

Concession Information: PT Rimbun Sawit Papua is located in West Papua province. The concession covers an area of 30,596 hectares.5 (Long 133° 6’58.80″E, Lat 2°55’32.52″S)

PT Sawit Timur Nusantara is owned by Dedi Mulyadi (2.5%) and PT Mulia Abadi Lestari (97.5%), which ultimately owned by Dedi Mulyadi and Junus Sutiono. PT Palmandiri Plantation is ultimately owned by Ir. Daud (99.2%), the President Director of PT Rimbun Sawit Papua.7

PT Mulia Abadi Lestari holds 28.6% shares in PT Duta Rendra Mulya8, a Salim-owned plantation company.

In 2012, four UAE holding companies (Prestige Holding Ltd., Malindo Investments Ltd, Crescent Investments Ltd, and Green Resources Ltd) believed to be affiliated with the Yemen-based HSA Group purchased a 80% stake in each of these four companies, located in the Boven Digoel district of West Papua, Indonesia: PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two concessions included in Tanah Merah project in Boven Digoel Regency. These concessions cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest have been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as their President Commissioner on their notary acts. Fouad Hayel Saeed is HSA Group’s subsidiary Pacific Inter-Link’s Managing Director & the Regional Director-Malaysia of the HSA Group. The documents also listed Salah Ahmed Hayel Saeed as the Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and the President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama. Hayel Saeed is the Director of Pacific Inter-ink’s refining division PT Pacific Palmindo Industri. Recent notary acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and the President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappeared from PT Kartika Cipta Pratama’s notary acts.

However, June 5, 2018 notary acts show no change in PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana shareholders. Hence, it is assumed that these companies remain affiliated with the HSA Group. Little is known about the new directors of the two concessions, except they include some notable individuals in Indonesian politics and business. Mr. Alwi Abdurrahman Shihab, former Foreign Minister of the Indonesian government, has become the president commissioner of PT MJR. Drs. Tommy Sagiman is now the commissioner of PT KCP. He is ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT MJR in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.

The HSA Group is one of the oldest business conglomerate in the Middle East, founded in 1938 by Al Haj Hayel Saeed Anam and his brothers Mohamed, Abdo and Gazern. The Group is today headed by Abdul Gabbar Hayel Saeed, its Chairman and CEO. The HSA Group is involved in the palm oil industry through its subsidiaries PT Pacific Palmindo Industri, PT Pacific Medan Industry, PT Pacific Indomas, PT Pacific Indopalm Industries, Pacific Oil & Fats Industries and Pacific Inter-Link, which are all RSPO members.17

Additional evidence shows continued family links to the PT Tulen Jayamas Timber Industries timber complex, a joint-venture project ‘with Bumimas Raya Sdn Bhd, Pacific Inter-Link Sdn Bhd, Yakin Dijaya Sdn Bhd and Al Salam Bank Bahrain’ announced by Tadmax Resources in 2012.18 The PT Tulen Jayamas Timber Industries timber complex is situated within the PT Kartika Cipta Pratama concession.

Malindo Investments Ltd which holds 80% shares in PT Kartika Cipta Pratama (see above), also holds 40% of the shares in the Malaysian-based parent company of PT Tulen Jayamas Timber Industries – ie Tulen Jayamas Sdn Bhd. Mr. Salah Ahmed Hayel Saeed and Mr. Fouad Hayel Saeed Anam are directors in Tulen Jayamas Sdn Bhd, in addition to their positions in the Indonesian subsidiary (PT Tulen Jayamas Timber Industries) as of 28 April 2018.

PT Megakarya Jaya Raya and PT Kartika Cipta Pratama are two of the concessions included in the Tanah Merah project in Boven Digoel Regency. These concessions in the Tanah Merah area cover a combined 155,330 hectares. Since January 2014, around 5,000 hectares of forest have been cleared in PT Megakarya Jaya Raya and PT Kartika Cipta Pratama.

Up until June 5, 2018, the four plantation companies had Fouad Hayel Saeed Anam listed as their President Commissioner on their Notary Acts. Fouad Hayel Saeed is the HSA Group’s subsidiary Pacific Inter-Link’s Managing Director & the Regional Director-Malaysia for HSA Group. The Acts also listed Salah Ahmed Hayel Saeed as the Commissioner of PT Energi Samudera Kencana & PT Megakarya Jaya Raya and the President Director of PT Graha Kencana Mulia & PT Kartika Cipta Pratama. Hayel Saeed is the Director of Pacific Inter- Link’s refining division PT Pacific Palmindo Industri. Recent Notary Acts confirm that on June 5, 2018, Fouad Hayel Saeed ceased to be President Commissioner of PT Megakarya Jaya Raya and PT Kartika Cipta Pratama, and Salah Ahmed Hayel Saeed is no longer Commissioner of PT Megakarya Jaya Raya and the President Director of PT Kartika Cipta Pratama. Nakul Rastogi also disappears from PT Kartika Cipta Pratama’s Notary Acts.

However, the June 5, 2018 Notary Acts show that there is no change in the shareholders of PT Megakarya Jaya Raya, PT Kartika Cipta Pratama, PT Graha Kencana Mulia and PT Energi Samudera Kencana. Hence, it is assumed that these companies remain affiliated with the HSA Group. Little is known about the new directors of the two concessions, except they include some notable individuals in Indonesian politics and business. Mr. Alwi Abdurrahman Shihab has become the president commissioner of PT MJR. He is a former Foreign Minister of Indonesia. Dr. Tommy Sagiman is now the commissioner of PT KCP. He is an ex-Inspector General of the police. Nata Singh Gurdev Singh became director of PT MJR in June 2018. Until April 2018, he worked for Sime Darby. Alwi Abdurrahman Shihab is the Indonesian President’s special envoy to the Middle East and the Organisation of Islamic Cooperation.

The HSA Group is one of the oldest business conglomerates in the Middle East, founded in 1938 by Al Haj Hayel Saeed Anam and his brothers Mohamed, Abdo and Gazern. The Group is today headed by Abdul Gabbar Hayel Saeed, its Chairman and CEO. The HSA Group is involved in the palm oil industry through its subsidiaries PT Pacific Palmindo Industri, PT Pacific Medan Industry, PT Pacific Indomas, PT Pacific Indopalm Industries, Pacific Oil & Fats Industries and Pacific Inter-Link, which are all members of the RSPO.

Supply Chain Information: 

Pacific Inter-Link used to trade with IOI and Nestlé10, however both companies have suspended trade with the company due to concerns over its involvement in deforestation. Unilever has suspended Pacific Inter-link from placement of new orders but Pacific Inter-link is still supplying Unilever until current binding contracts run out. It is unclear where Pacific Inter-Link now sells its palm oil, but being a Middle Eastern company, it most likely has an alternative market in this region and in East Africa.

This concession was featured in the Rapid Response Report 4: between March to May 2018 a total of 904 hectares of forest were cleared. For the period September 2017 to June 2018, more than 1,500 hectares of peatland forest and non-forested peatland were cleared or developed in the BLD Plantation Bhd concession.

Deforestation: PT Permata Putera Mandiri Blok I (PT PPM) was featured in Rapid Response Report 3 due to clearance, and that clearance has continued since the release of the report. We found 668 hectares of clearance between June 2017 and December 2017. Satellite imagery (see below) shows that 951 hectares of forest were cleared in the concession from March 11 to May 25, 2018.

Mr. Chiong Ho Ling is the chairman and founder of Shin Yang Group of companies. He also serves as executive chairman of Sarawak Oil Palms Bhd. Sarawak Oil Palm Bhd had recently purchased Shin Yang Oil Palms Sdn Bhd.

Deforestation: PT ACP was featured in Rapid Response Report 3. There were 2,847 hectares cleared in 2015 and 2016, evidence of new stacking lines from November to December 2017, and clearing of 70 hectares from November 2017 to January 2018. The 5% remaining are owned by PT Karya Agung Megah Utama (KAMU), controlled by Ganda and Jacqueline Sitorus whom hold 68% and 32% of the shares respectively, while Andy Indigo is Director.

Deforestation: We detected 1,348 hectares of forest alerts in October of 2017. After inspecting the imagery, we found an area of 5,600 hectares cleared beginning in March 2016 and continuing through December 2017.

Ownership Information: 

PT Sawit Mandiri Lestri was sold by Sawit Sumbermas Sarana (SSMS) in December 2015 while there was a RSPO complaint pending inititated by the NGOs Environmental Investigation Agency and JPIK Kalteng. The company is, therefore, no longer subject to the RSPO’s Principles and Criteria. PT SML is 60% owned by Rinawati and 40% owned by Hamidi Mukhdar Said, through PT Metro Jaya Lestari.

No information could be found concerning Rinawati but Hamidi Mukhdar Said is a member of Commission IV of the house of representatives of Indonesia. The director mentioned in PT SML’s notary act is also the commercial director of SSMS (Ramzi Sastra) and the address of PT SML is the same as the address of another plantation company belonging to SSMS. This concession still appears to be connected to the Abdul Rasyid family.

PT Harapan Rimba Jaya is a subsdiary of Tsani Hutani Abadi Group, ultimately owned by Centrino Investment Ltd, registered in Labuan Island.

Tsani Hutani Abadi also owns two other plantation companies in Kutai Barat, namely PT Rayatama Jaya and PT Kruing Lestari Jaya.

Tsani Hutani Abadi’s president director, Mulyawan Tjandra, is an ex-executive director of Indo Agri Resources (bit.ly/2BSUbvy).

PT Duta Rendra Mulya and PT Sawit Khatulistiwa Lestari (ex PT Simpi Indai)



Concession Information: The previously PT Simpi Indai concession is now divided in two plantations: PT Duta Rendra Mulya (PT DRM) and PT Sawit Khatulistiwa Lestari (PT SKL), located in West Kalimantan, Ketungau district. Based on the 2015 IUP permit they cover respectively an area of 7,364 and 12,151 hectares.

Deforestation: From October 2016 to October 2017, PT DRM cleared 772 hectares of peat forest (721 ha), forest (18 ha) and peat (33 ha). PT SKL cleared 1,189 hectares of peat forest (1,166 ha) and peat (23 ha). The total deforestation for those two plantation companies amounts to 1,961 hectares for that period of time.

Concession information: PT Bintuni Agro Prima Perkasa (PT BAPP) is located in Papua, Sorong province. Based on the forestland release permit it covers an area of 32,570 hectares.

 

 

 

 

Deforestation: Satellite imagery (see below) shows that 138 hectares of peat and peat forest were cleared on the eastern part of the concession from October 2016-August 2017.

 

Supply Chain: Based on mill vicinity (see map), PT BAPP likely supplies FFB to PT Yong Jing Investama, which does not feature on any public supplier lists.

Ownership Information: There are many linkages between PT BAPP and Salim Group:

• The plantation company is ultimately owned by Mr. Ir Daud through PT Cahaya Agro Pratama. Mr. Ir Daud is a former director of PT Duta Rendra Mulya, which is linked to Salim Group.

• Mr. Gunawan Sumantri, the president director of PT BAPP is also a former director of Salim companies: PT Duta Rendra Mulya and PT Andhika Wahana Putra. He is also the President Director of other plantation companies–PT Berau Sawit Sejahtera, PT Citra Palma Sejati, PT Duta Sejahtera Utama, PT Perdana Sawit Plantation, PT Subur Karunia Raya, PT Wahana Tritunggal Cemerlang and PT Wira Inova Nusantara [bit.ly/2jGeIeH]

• The concession has been publicly linked to Salim Group as one of four ‘secret’ plantations in West Papua, totalling 117,000ha

Concession information: PT Guntur Madu Agrotama (PT GMA) is located in Bengkulu district in Sumatra and covers an area of 4,082 hectares, according to the HGU permit.

 

 

Deforestation: PT GMA deforested at least 92 hectares of forest from December 2016 to August 2017. See images below.

 

 

Supply Chain: PT GMA likely supplies FFB to PT Alno Agro Utama, owned by Anglo Eastern Plantations. Its main known buyers are GAR, Wilmar, Cargill and ADM.

 

 

 

 

 

PT Kahayan Agro Plantation


 

 

 

Concession information: PT Kahayan Agro Plantation is located in Gunung Mas Regency, Central Kalimantan, and covers an area of 17,500 hectares.

 

 

 

 

Deforestation: Between October 16, 2016 and September 26, 2017, an estimated 420 hectares were deforested (see satellite imagery below), including clearing of Bornean orangutan habitat as per the most recent orangutan distribution maps [Utami-Atmoko and al.: Orangutan Population and Habitat Viability Assessment: Final Report. IUCN, 2017]

Prior to October 2016, an estimated 3,593 hectares were cleared, including over 700 ha of orangutan habitat.

Supply chain: PT KAP likely supplies FFB to PT Tantahan Panduhup Asia, owned by Sumber Tani Agung, which is a known supplier to Wilmar.

Ownership information: PT Kahayan Agro Plantation is owned by Anglo Eastern Plantations.

 

 

Land conflicts and licensing issues at PT KAP:

Within two weeks of the acquisition of PT KAP by Anglo Eastern Plantations in 2010, the Regent of Gunung Mas issued a Plantation Business Permit (IUP) for the entire area, despite no Environmental Impact Analysis (AMDAL) having been carried out. During the subsequent AMDAL process, local Dayak communities stressed that they did not want the company on their lands.

The concerns of local people resulted in the Regent issuing a decree to PT KAP to excise local land from their concession, and banned them from negotiating land sales with local people without the regency government’s permission.

In January 2013, the Governor of Central Kalimantan issued a directive that PT KAP must comply with the Regent’s instruction, and conduct an inventory of all land claims within the concession.

Despite this, PT KAP continued its own process of acquiring land, and the directives from both the Regent and Governor appeared to have been ignored. Customary lands were not excised from the IUP area.

In 2012, a Permit for wood utilization (IPK) was issued to a third-party, PT Kahayan Hutan Lestari (KHL). Clearing and planting began on the plantation [bit.ly/2glvOhq].

In 2014, NGO reports accused PT KHL of clearing more timber on the concession than was stipulated in its license, and PT KAP of operating without a HGU license [bit.ly/2uSSq17].

 

 

 

 

 

PT Mustika Agung Sentosa



 

 

Concession information: PT Mustika Agro Sentosa (PT MAS), is a plantation company located in West Kalimantan with an area of 19,792 hectares, based on IUP permit.

 

Deforestation: Between January 2017 and August 2017, PT MAS cleared around 10 hectares of forest on the South and Northeast of its concession.

 

 

Supply chain: Based on mill vicinity (see map), PT MAS likely supplies FFB to PT Parindu or Simpang Hulu Barat, which main known buyers are Wilmar, IOI, Cargill and ADM. 

Ownership information:

• PT MAS is ultimately owned by Pribadi and Wiyono families (50/50%) through PT Citra Bumi Semesta and PT International Timber Inticor, respectively.

• Mr. Henry Pribadi, whose real name is Liem Oen Hauw, owns 77.5% shares in PT Citra Bumi Semesta, while his children own the remaining 22.5%. Mr. Henry Pribadi is one of the richest Indonesians who owns, among others, Napam cement group and the famous SCTV television network [bit.ly/2i8SA04].

• He is the cousin of Mr. Djuhar Sutanto, a very close business partner of Mr. Sudono Salim (father of Anthony Salim) and is also sitting as secretary and commissioner of some Salim’s companies [bit.ly/2g6GGQ0, bit.ly/2i8Bz6r].

• PT International Timber Inticor is owned 50/50% by Ellen and Jeffry Wiyono.
